Welcome to Kalios! These Terms of Use ("Terms") govern your use of the Kalios mobile applications, website, and related services. By using our services, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using Kalios (the "Platform"), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Platform.

2. The Services

Kalios provides two related services:

• The Kalios athlete app — a training application for individuals: personalized workout plans, workout logging, progress and body metrics, nutrition guidance, community features, and an AI coach.
• The Kalios coach platform — software tools for fitness coaches and gym businesses: client management, programming, scheduling, forms, resources, and billing.

Together, the "Services". The specific features available to you depend on which product you use and, where applicable, your subscription.

3. Eligibility and Accounts

Eligibility

You must be at least 16 years old, or the age of digital consent in your country if higher, to use the Platform.

Account Creation

To access the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Kalios is not liable for any loss or damage resulting from unauthorized access to your account caused by your failure to protect your credentials.

4. Subscriptions and Payment

Kalios Pro (athlete app)

The athlete app offers an optional auto-renewable subscription, Kalios Pro, available in monthly and annual plans. The price is shown in the app at the point of purchase, in your local currency. Payment is charged to your Apple App Store or Google Play account when you confirm the purchase.

• Auto-renewal. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your store account is charged for the renewal within 24 hours before the current period ends, at the then-current price.
• Managing and cancelling. You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the app or your Kalios account does not cancel a store subscription. After cancelling, you keep access until the end of the current billing period.
• Refunds. Purchases made through the App Store or Google Play are processed by Apple or Google, and refunds are governed by their respective policies. Kalios cannot issue refunds for store purchases directly.
• Price changes. If a subscription price changes, you will be notified in accordance with the store's rules and, where required, asked to consent before the new price applies.

New athletes may receive an introductory period of premium access granted by Kalios. This is a feature of the Services, not a store free trial: it requires no payment method, does not convert into a paid subscription automatically, and is granted once per account.

Coach platform subscriptions

Coach platform subscriptions are billed separately, on a recurring basis, through our payment processor. Fees are due in advance and are non-refundable except where required by law or explicitly stated. You may cancel at any time; your workspace remains active until the end of the current billing cycle.

5. Health and Medical Disclaimer

Kalios is not a medical device and does not provide medical advice. All content in the Services — including workout plans, exercise instructions, recovery signals, nutrition and calorie guidance, and AI coach responses — is provided for general informational and fitness purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

• Consult a physician or qualified health professional before starting any exercise or nutrition program, especially if you have (or suspect) a medical condition, an injury, are pregnant, or take medication.
• Physical exercise carries inherent risks, including the risk of injury. You voluntarily assume those risks when you train. Stop exercising immediately and seek medical attention if you feel pain, dizziness, shortness of breath, or discomfort.
• Nutrition guidance in the Services is informational and general in nature. It is not dietetic or medical advice and is not intended for the treatment of any condition, including eating disorders.
• Never disregard or delay seeking professional medical advice because of something you saw in Kalios.

To the fullest extent permitted by law, Kalios is not liable for any injury or health outcome arising from your use of the Services or from your reliance on their content.

6. AI Features

The Services include features powered by artificial intelligence ("AI"), such as the AI coach, plan generation and adaptation, and chat responses. By using them, you acknowledge that:

• AI-generated content may be inaccurate, incomplete, or unsuitable for your circumstances. Use your own judgment, and treat it as guidance — not as medical, dietetic, or professional advice (see Section 5).
• To provide AI features, Kalios may process your inputs and relevant account data (such as your training history and fitness profile) using third-party AI service providers, as described in our Privacy Policy.
• If you are a coach, you are responsible for reviewing the accuracy and appropriateness of AI-generated content before using it or sharing it with your clients.
• Kalios is not liable for outcomes resulting from your use of AI-generated content or recommendations.

The use of AI features may be subject to additional policies or restrictions communicated through the Platform. You agree to comply with such policies.

7. User Content and Community

The Services let you create and share content — for example workout check-ins, posts, comments, messages, and profile information ("User Content"). You retain all rights to your User Content. You grant Kalios a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it solely to operate and provide the Services — for example, showing your posts to the groups you share them with.

You are responsible for your User Content. We may remove content or restrict accounts that violate these Terms, and we may preserve anonymized shared content when an account is deleted, as described in our Privacy Policy.

8. Acceptable Use

You agree to use the Platform only for lawful purposes. You will not:

• Violate any laws or regulations.
• Transmit or upload any harmful, defamatory, obscene, or otherwise offensive content.
• Harass, bully, or harm other users, including in community features.
• Attempt to access another user's account or data without authorization.
• Interfere with, disrupt, reverse engineer, or circumvent security or access controls of the Platform.
• Use the Platform to promote or distribute illegal or harmful products or services.

Kalios reserves the right to suspend or terminate any account that violates these Terms.

9. Coaches and Clients

Kalios is a software platform. Coaches on the coach platform are independent professionals, not employees or agents of Kalios. Kalios does not supervise, endorse, or guarantee any coach, their qualifications, or the programs they deliver, and is not a party to the relationship between a coach and their client. Coaches are solely responsible for the services and content they provide to their clients and for complying with the laws and professional requirements that apply to them.

10. Intellectual Property

All intellectual property rights in the Platform — including software, design, logos, trademarks, the exercise library, and other content provided by Kalios — are owned by Kalios or its licensors. You may not reproduce, modify, distribute, or otherwise use any part of the Platform without prior written consent, except as allowed by these Terms.

11. Third-Party Services

The Platform integrates with third-party services — for example the Apple App Store, Google Play, payment processors, and optional health integrations such as Apple Health, Android Health Connect, and Google Health (Fitbit). Your use of a third-party service is subject to that service's own terms and privacy policy, and Kalios is not responsible for third-party services it does not control. Health integrations are optional and described in detail in our Privacy Policy.

12. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, Kalios disclaims all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.

To the fullest extent permitted by law, Kalios and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, including loss of profits, data, or business opportunities. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, and if you are a consumer, you keep all rights granted by the mandatory consumer-protection laws of your country of residence.

13. Termination

We reserve the right to suspend or terminate your account if we reasonably believe you are in violation of these Terms or engaging in activities that may harm the Platform, other users, or third parties. You may stop using the Platform and delete your account at any time from within the app; deletion is described in our Privacy Policy. Cancelling billing is separate and handled as described in Section 4.

14. Modifications to Terms

We may revise these Terms from time to time. If we make significant changes, we will notify you by email or through the Platform before they take effect. By continuing to use the Platform after the changes take effect, you agree to be bound by the updated Terms.

15. Governing Law

These Terms are governed by the laws of Spain, without regard to its conflict-of-laws principles. Disputes arising under these Terms shall be resolved by the courts of Spain. If you are a consumer residing in the European Union or elsewhere, you also benefit from any mandatory protections, and may bring proceedings before the courts, of your country of residence.
